Keep your programmatic ads running by staying compliant
If you're running programmatic ads in your emails through Kit Ads, you'll need to include a subscriber opt-out link for preference-based ads in every email that contains programmatic ads. We also strongly recommend updating your privacy policy to mention preference-based advertising.
These steps protect your subscribers' privacy and help keep you in compliance with applicable data privacy regulations.
What's required?
Every email that contains programmatic ads must include an opt-out link so subscribers can opt out of preference-based, personalized ads.
This opt-out link doesn't remove ads from your emails entirely. Subscribers who opt out will simply receive non-personalized ads instead of ads targeted to their preferences.
We also strongly recommend adding language about preference-based advertising to your privacy policy.

Including an opt-out link for preference-based ads is a legal compliance requirement that protects consumer privacy. It also signals transparency and helps build trust with your audience.
Without this link, you risk serving personalized ads to subscribers without giving them a way to opt out — which could put you in violation of applicable data privacy regulations.
How to add the opt-out link
1. Open your email template
Open the email template(s) you use to run Kit Ads. You'll need to add the opt-out link to every email template that contains an Ad Slot.
2. Add the opt-out snippet to your footer
In the footer area of your email, add the following snippet:

This snippet automatically generates a link in your sent emails, directing subscribers to a simple form where they can manage their ad preferences.
3. Repeat for all email templates with ads
Make sure you add this snippet to every email template that includes an Ad Slot — including any Broadcast and Sequence emails that run programmatic ads.
How to update your privacy policy
We strongly recommend reviewing your website's privacy policy to make sure it covers preference-based advertising. Clear language about this practice matters for both compliance and transparency.

What happens if I don't comply?
If your emails contain programmatic ads but don't include the required opt-out link by the compliance deadline, programmatic ads will be automatically removed from those emails. Your emails will still send as normal — they just won't include programmatic ads until you're back in compliance.
That means you'll miss out on ad revenue until the opt-out link is added.

No — your emails will still send as normal. After the compliance deadline, however, programmatic ads will be automatically removed from emails that don't include the opt-out link, and you won't earn ad revenue from those emails.
What about emails I've already scheduled?
If you have scheduled emails that contain Ad Slots, you'll need to update them to include the opt-out link. If you have a large number of emails that need updating, email help@kit.com and we'll help you out.
What happens to subscribers who opt out of preference-based ads?
They'll still see ads in your emails, but those ads will be randomly selected (within your brand preferences) rather than personalized to their interests. They may also see fewer ads overall, since our system can no longer match them with the most relevant options.
My privacy policy already mentions interest-based advertising. Do I still need to update it?
If your privacy policy already covers preference-based advertising, you may be good to go. That said, we recommend checking with a legal professional to confirm your language covers your specific situation.
